Travel Agency Terms and Conditions
Effective Date: January 1, 2025
Please read these Terms and Conditions carefully, as they contain important information regarding the booking of travel products and services with Experiences by Alexis ("Agency," "we," "us," or "our").
By booking a travel product and/or service through Experiences by Alexis, whether directly, through electronic communication, invoicing, payment links, or a third party booking platform, you expressly accept these Terms and Conditions without modification, intend to be legally bound by them, and acknowledge that they form part of your contract with Experiences by Alexis and the applicable travel suppliers.
These Terms and Conditions apply to all transactions facilitated by Experiences by Alexis, including bookings made through email, invoices, proposals, forms, payment links, or any affiliated booking system. The lead guest is responsible for providing accurate contact information for all travelers on the reservation and for ensuring that all members of the travel party are aware of and agree to these Terms and Conditions. By proceeding with booking and submitting payment, you authorize Experiences by Alexis to charge the credit card provided and confirm acceptance of all terms below.
1. Role of Experiences by Alexis
Experiences by Alexis acts solely as a sales agent for third party suppliers that provide travel related services. These suppliers include, but are not limited to, airlines, hotels, resorts, tour operators, transfer providers, excursion operators, cruise lines, shuttle services, and wedding or entertainment service providers.
Experiences by Alexis does not own, operate, manage, or control these suppliers and is not responsible for their acts or omissions. We assume no liability for personal injury, bodily injury, illness, death, property damage, theft, loss, accident, delay, inconvenience, overbooking, schedule change, cancellation, or any other loss or damage suffered during travel.
This includes, but is not limited to, damages or losses arising from acts or omissions of suppliers, other travelers, third parties, or from events beyond our control, including weather, natural disasters, mechanical issues, labor disputes, acts of God, government actions, civil unrest, health related incidents, or flight disruptions that result in missed portions of travel.
2. Group Travel and Reservation Authority (Single Room and Multi Room)
For any reservation that includes more than one traveler under a single booking number, whether sharing one room or occupying multiple rooms, a Group Lead is designated. The Group Lead is the first named traveler on the reservation and the individual who initiates the booking and submits the initial deposit.
By signing documents and or submitting payment, the Group Lead acknowledges and agrees to act on behalf of all travelers associated with that booking number. The Group Lead has sole authority to:
Accept terms, disclosures, and supplier policies on behalf of the group
Request and approve changes to the reservation
Submit cancellation requests
Remove travelers from the reservation
Receive refunds on behalf of the group
The Group Lead assumes responsibility for communicating all information, deadlines, policies, and requirements to the rest of the group. Acceptance of these Terms by the Group Lead constitutes acceptance by all travelers listed on the reservation.
If a group reservation is canceled in full, refunds will be issued to the Group Lead unless individual travelers paid directly with their own payment method. All refunds will be returned to the original form of payment used.
If one or more travelers choose to no longer travel while other members of the reservation continue, the departing traveler understands and agrees that their payments may be non refundable and subject to supplier penalties and agency fees.
For group travel involving multiple rooms, a designated Group Leader may coordinate decisions affecting the group; however, each individual booking remains financially responsible for their own room, payments, and obligations unless otherwise stated in writing.
3. Entry Requirements and Denied Entry
All travelers are solely responsible for ensuring they meet entry requirements for their destination. This includes valid passports, visas, vaccinations, permissions for minors, and compliance with immigration and customs laws.
Names must match government issued photo identification exactly. Travelers with criminal convictions, legal restrictions, or incomplete documentation may be denied entry. Minors traveling without both parents may require notarized consent letters.
Experiences by Alexis is not responsible for denied entry into any country. Denied entry may result in total financial loss of the trip with no refund.
4. Passport Acknowledgement
A valid passport is required to enter another country and must not expire within six (6) months of travel. Travelers are responsible for meeting all entry requirements, including passport validity, visas if applicable, and immigration regulations.
Minors traveling without both parents may require notarized consent. Travelers with incomplete documentation or legal restrictions may be denied entry.
Experiences by Alexis is not responsible for denied entry. Denied entry may result in total financial loss of the trip with no refund.
By proceeding with booking, you confirm that you and all travelers associated with the reservation have valid passports that will not expire within six (6) months of the travel date. You accept full financial responsibility for any loss resulting from denied entry due to an invalid, expired, or missing passport.
5. Supplier Policies
Supplier policies govern refunds, cancellations, changes, room assignments, amenities, and service levels. Once booked, all reservations are subject to the supplier’s terms, which may be stricter than those of Experiences by Alexis.
6. Credit Card Authorization
You certify that you are the authorized cardholder or have permission to use the payment method provided. You authorize Experiences by Alexis and or its suppliers to charge all approved amounts related to your reservation.
Supplier names may appear on your credit card statement. Payment processing may take three to five business days.
7. Accuracy of Booking Information
You are responsible for reviewing all confirmation documents upon receipt. Any errors must be reported within seventy two (72) hours. Failure to report errors within this time frame constitutes acceptance of the reservation as accurate.
8. Transportation Disclaimer
If airport transportation is offered and declined, you acknowledge that by not adding airport transportation to the reservation, you are solely responsible for arranging transportation to and from the airport for yourself and all travelers associated with the booking. This includes transportation between Montego Bay International Airport and Negril, when applicable.
You accept full responsibility for any costs, delays, or issues related to transportation for yourself and your party.
9. Travel Insurance Disclosure
Travel insurance helps protect your investment if unexpected events occur before or during your trip. It may cover trip cancellations, delays, medical emergencies, and lost luggage. Once a reservation is booked, payments are typically non refundable, making insurance especially important. Experiences by Alexis strongly encourages all travelers to purchase coverage for peace of mind.
Experiences by Alexis is not an insurance agency and does not sell, solicit, or negotiate insurance policies. Travel protection is optional and non refundable once purchased.
Travel Insurance Waiver and Acknowledgment
By declining travel insurance, you acknowledge that Experiences by Alexis has offered you the opportunity to purchase coverage. You understand that travel involves inherent risks, including participation in excursions or activities.
By declining coverage, you accept full financial responsibility for any loss, injury, damage, delay, cancellation, or additional expenses that may occur, including airline, supplier, or agency fees. You release Experiences by Alexis and its agents from any and all liability related to your trip.
If a separate travel insurance election or waiver is not submitted by all travelers on the reservation within seven (7) days, this waiver will serve as a formal decline of travel insurance for all parties traveling under the booking. The Group Lead confirms authorization to make this election on behalf of the reservation.
10. Changes to Reservations
Changes requested more than twenty four (24) hours after confirmation are subject to a change fee and any supplier imposed penalties. This includes name changes, date changes, room changes, and destination changes.
All change fees are non refundable.
11. Fees, Retainers, and Cancellations
All service fees paid to Experiences by Alexis are non refundable and non transferable.
A cancellation fee of one hundred dollars ($100) per person applies to all cancellations, regardless of reason.
All cancellation requests must be submitted using the official cancellation form located at https://www.experiencesbyalexis.com/cancellation-form.
By submitting a cancellation form, you confirm that you are authorized to act on behalf of all guests associated with the reservation. Once canceled, the reservation cannot be reinstated and any future travel will require rebooking at the then current rates and availability.
12. Chargebacks, Disputes, and Collections
By authorizing payment, you agree that this Agreement is binding and waive the right to initiate a chargeback or payment dispute for any reason other than verified fraud.
If a chargeback is filed without valid cause, you are responsible for all associated costs, including administrative fees, bank fees, legal fees, and collection costs.
13. Client Conduct and Communication
Clients agree to maintain respectful and reasonable communication. Excessive or harassing communication does not constitute an emergency and is not required to be accommodated.
14. Events Beyond Our Control
Experiences by Alexis is not responsible for flight cancellations due to weather, airline decisions, labor disputes, government actions, currency exchange fluctuations, supplier pricing changes, or availability shifts.
15. Use of Personal Information
You authorize Experiences by Alexis to use your personal information for booking travel related services. Information is shared only with suppliers necessary to fulfill your arrangements.
16. Health, Safety, and Government Regulations
You acknowledge that health risks, including communicable diseases, exist during travel and that government requirements may change without notice. Experiences by Alexis is not liable for supplier or government decisions.
17. Governing Law and Jurisdiction
This Agreement is governed by the laws of the state in which Experiences by Alexis is registered. Any legal action shall be brought in the appropriate courts of that state.
18. Applicability to All Travelers and Acknowledgment
These Terms and Conditions apply to all travelers on the reservation. By proceeding with booking, the Group Lead certifies acceptance on behalf of all travelers and confirms that all parties have been offered the opportunity to purchase travel protection and agree to these Terms and Conditions.
